Cong RS member seeks leave to amend Act : Kadyan Khap International


What is being perceived as a tactical move to pacify the growing demand by khaps, Haryana Congress Rajya Sabha member Shadi Lal Batra has given a notice to move an amendment to the Hindu Marriage Act, 1955, prohibiting tsame-gotra and same-village marriages.

Batra belongs to Rohtak and is a confidant of Chief Minister Bhupinder Singh Hooda. He gave the notice seeking permission to introduce the “Hindu Marriage Act (Amendment) Bill, 2010” to the Rajya Sabha secretariat yesterday.

The notice said he should be given leave to introduce the Bill during the 220th session of the Rajya Sabha, which concluded today. Now the Bill would be taken up during the next session, if Batra is allowed by the House to do so. A copy of the Bill submitted to the Rajya Sabha secretariat proposes that the following should be inserted in Section 5 of the Hindu Marriage Act after sub-clause (5): “That the parties (to a marriage) are not sapindas of each other, belonging to the same gotra/parivara and residing in the same village.”

In the “statement of objects and reasons” attached by Batra, a lawyer by profession, he says that “social fabric and mutual ties are so strong in rural areas that its violation is not swallowed. “Age-old customs and tradition is that the entire village is considered a unit and its young folk as brothers and sisters. his cultural commitment has gone a long way in ensuring dignity and safety of womanhood in day-to-day activities at their place of work and residence.

“Vedic literature and the seers prohibited marriages in the same gotra or parivara. Further, custom and age-long tradition prohibited marriages in the same village and in the same gotra and sapindas of each other. “In the recent past some unscrupulous youths started violating the customs and values of society by nuptial ties, prohibited otherwise.

This has caused a stir in society and a mass movement to condemn such illegal relationship has started. It is, therefore, high time that the Hindu Marriage Act be amended to specifically include barring marriages in the same gotra and parivara, and residing in the same village.” It is no secret that major political parties in the state, the Congress and the Indian National Lok Dal (INLD), do not want to annoy the khaps for fear of losing Jat votes.

The INLD put the ball in the Congress court when its president Om Prakash Chautala announced that his party would support the government if it brought an amendment in the Hindu Marriage Act to prohibit same-gotra marriages.

If the Congress failed to do so, his party would move the amendment on its own, he declared. The Congress leaders are reluctant to associate their party with any move that is certain to invite critricism by liberal sections of society. By making one of its MPs to move the amendment as a “private member’s Bill”, the party has avoided just that. The khaps have threatened to gherao the Kaithal residence of Congress MP Naveen Jindal on May 10 for his alleged failure to support their demand.

AN Indian National Lok Dal ( INLD) MLA came out in support of the caste panchayats or khaps on Sunday.

This was at a mega caste panchayat meet at Pai near Kurukshetra where members assembled and gave “ elected representatives of the state” a month’s notice to support their campaign.

The members have been tirelessly protesting against same sub- caste or same gotra marriages for quite some time. However, it took little time to get a favourable response.

Rampal Majra, the INLD MLA, said he “ subscribed to the cause and supported it.” The maha- panchayat meeting was convened to discuss the legitimacy of the same gotra marriage and seek an amendment of the Hindu Marriage Act.

Majra, who represents the Kalayat assembly constituency, attended Sunday’s meeting and declared his support for the caste panchayats. He also called for an amendment in the Hindu Marriage Act.

The MLA assured the gathering at Pai that he would ask the Congress government in the state to raise their demands before the Centre.

“ Politicians should respect the people’s sentiments and uphold the tradition,” Majra said. “ We will urge the ruling party to adopt a resolution against same gotra marriages and put them on the mat in the assembly if they fail to initiate such a move. We support the demands of the khap panchayats in the state,” he added.

The representatives of about 90 caste panchayats or the caste courts in Haryana also adopted a resolution during the meeting.

They asked the MPs to declare their support for the cause.

The members of the caste panchayats said they would bar state MPs from entering their villages if they fail to back them. The representatives also decided to assemble again in Kurukshetra on May 10 and protest against Naveen Jindal, the Congress MP from Haryana.

“ We will decide on our next course of action on May 10,” said Randhir Singh, president of Meham Chaubisi Khap.

Naresh Kadyan, convenor of Kadyan Khap International, said the community’s demand was “ reasonable and it was for the sake of restoring social norms”. Kadyan, who did not attend Sunday’s meeting, said: “ Why can’t we demand a change? It is our democratic right.”

NHRC issues notices to Haryana Government on alleged diktats of Khap (Caste) Panchayats

The National Human Rights Commission has taken suo motu cognizance of media reports published on 17.07.2009 alleging that Kadyan Barha Khap (Caste) Panchayat delivered a verdict to Ravinder Gehlout of Dharan village, District Jind, Haryana to divorce Shilpa Kadyan as their marriage was in violation of social norms. The reports said that when the bride's parents rejected this verdict, the panchayat issued a diktat to the family to leave the village within 72 hours. In the circumstances, Ravinder desperately attempted to commit suicide and is reportedly under going treatment. It was also reported that the victims were leaving under threat of Khap Panchayat and the District Administration is not able to provide appropriate protection to them.

The Commission observed that the contents of press reports, if true, raise serious issue of violation of human rights of the victims and issued notice to the Chief Secretary, Haryana Government calling for a factual report within four weeks from the date of receipt of the notice.

The Commission has also taken suo motu cognizance of another such event involving the diktat of Khap Panchayat reported by media on 24.07.2009. The Panchayat disapproved the marriage of Ved Pal Mor of Matour village in Kaithal District who married a girl of his own sub-caste after eloping with her. The girl hailed from village Singhwal District Jind in the State. When Ved Pal, after obtaining an order from the Court, accompanied by police reached for the custody of his wife in Singhwal on 22.07.2009, he was lynched by the villagers. His family members had allegedly held police responsible for inaction.

हरियाणा के गांव ढराणा का गोत्र विवाद अब भी अपनी जगह पर है। बुधवार को दूबलधन में कादियान खाप व दूसरे पक्ष की पंचायतनहीं होने से पीड़ित गहलोत परिवारों को राहत नहीं मिल पाई। उन्हें अभी भी प्रवासियों की तरह अपने रिश्तेदारों में रहना पड़ रहा है। हालांकि ढराणा से पीड़ित परिवारों के चले जाने के बाद माहौल अब शांत दिख रहा है।

बुधवार को दूबलधन में होने वाली दोनों पक्षों की पंचायत में मध्यस्थ की भूमिका निभा रहे एक प्रमुख व्यक्ति की गैरमौजूदगी के कारण नहीं हो पाई। बैठक गुरुवार को होने की उम्मीद है। इसके कारण पीड़ित परिवार बुधवार को भी पुलिस सुरक्षा के बीच अपनी रिश्तेदारी में ही शरण लिए रहा। अभी एक बार गहलोत परिवारों के गांव छोड़ने से तनाव भले ही काफी कम हो गया हो। लेकिन मामले को लेकर अब भी खाप द्वारा ज्यादा नरम रुख न अपनाए जाने के संकेत मिल रहे है।

कादियान खाप के फरमान से उठे बवाल पर पुलिस व प्रशासन को कानून व्यवस्था बनाए रखने के लिए लाखों रुपये की राशि खर्च करनी पड़ी व डेढ़ दर्जन पुलिसकर्मी घायल हो गए। वहीं गांव ढराणा में सप्ताह भर से क‌र्फ्यू जैसे हालात बने रहे।

पहले भी होते रहे हैं रिश्ते

ढराणा गोत्र विवाद का मुख्य कारण गांव के गहलोत परिवार के युवक द्वारा कादियान गोत्र की लड़की के साथ शादी करना था। ऐसा भी नहीं है कि गहलोत व कादियान गोत्र के बीच रिश्ते नहीं होते है। यहां तक की गांव ढराणा के कादियान गोत्र के परिवार ने भी लगभग चार दशक पहले दो लड़कियों की शादी गहलोत गोत्र के लड़कों के साथ की थी।

सबसे बड़ी बात है कि गोत्र के नाम पर पंचायत के एक अगुवा व्यक्ति का तो गोत्र तक भी कादियान नहीं है। इस विवाद में भले ही पीड़ित परिवार गहलोत गोत्र से संबंध रखता हो। लेकिन कुछ ऐसा ही फैसला गांव जौंधी में हुए अशीष-दर्शना के मामले में गहलोत खाप द्वारा भी सुनाया गया था। इसमें पीडि़त दंपती द्वारा अदालत की शरण लिए जाने व अन्य सामाजिक संगठनों द्वारा मामला उठाए जाने के बाद न्याय मिल पाया था। ढराणा गोत्र विवाद मामले में भी भले ही प्रशासन भी सामाजिक सद्भाव कायम रखने के लिए खाप के आगे झुककर मामले को निपटाने की कोशिश कर रहा हो लेकिन खाप से जुड़े सूत्रों से मिले संकेतों के अनुसार इस मामले में भी रविंद्र व शिल्पा के आजीवन गांव निष्कासन के अलावा रविंद्र के पिता रोहतास को भी गांव से काफी समय तक दूर रहना पड़ सकता है।

कादियान खाप के खिलाफ याचिका

चंडीगढ़, जागरण संवाददाता। हरियाणा के झज्जर जिले के ढराणा गांव का गोत्र विवाद बुधवार को हाईकोर्ट पहुंच गया। कादियान खाप द्वारा गहलोत परिवारों को गांव से निकालने के फैसले के खिलाफ रविंद्र ने हाईकोर्ट में याचिका दाखिल की है। इसमें कादियान खाप के खिलाफ कार्रवाई करने की मांग की गई है। साथ ही रविंद्र के परिवार को सुरक्षा देने के लिए कहा गया है। इस याचिका पर सुनवाई गुरुवार को होगी।

रविंद्र ने अपनी याचिका में हरियाणा सरकार, आईजी पुलिस, एसएसपी और एसएचओ को पार्टी बनाया है। गौरतलब है कि ढराणा निवासी रविंद्र का शिल्पा से विवाह हुआ था। रविंद्र गहलोत गोत्र से संबंध रखता है, जबकि शिल्पा कादियान गोत्र से। गांव के कादियान परिवारों ने इस विवाह का विरोध करते हुए इसको तोड़ने का आदेश दिया था। रविंद्र के परिवार ने इस रिश्ते को तोड़ने से इन्कार कर दिया था। इस पर खाप ने रविंद्र के परिवार को गांव से निकालने का आदेश दिया था।

The gotra controversy over the three-month-old marriage of Ravinder and Shilpa Rani from Dharana village in Jhajjar district today reached the Punjab and Haryana High Court. The petition is listed for preliminary hearing on Thursday before Justice KC Puri.

In a petition jointly filed by Ravinder and his father Rohtash, directions to the state of Haryana and other respondents have been sought for protection of life and liberty. Directions have also been sought to the state authorities concerned to initiate immediate action against autocratic individuals interfering and issuing diktat to break the nuptial knot.


Even as the Gehlout family has left Dharana village here after reportedly “bowing down” to the Kadyan Barah khap panchayat’s order for “violation of social norms” in solemnisation of marriage with Shilpa of Kadian gotra, hopes are still alive for change in the verdict of the khap panchayat.

Both the parties - the khap panchayat and the Gehlout family - resumed negotiations on the issue to find out an amicable solution to the controversy by holding a meeting in Dubaldhan village here today.

According to information, the Gehlout family requested the Kadian khap to soften its orders of “expulsion” as it was not possible for them to leave the village permanently due to inevitable reasons. During the meeting, Naseeb Singh, uncle of groom Ravinder Gehlout, submitted an application for apology with the khap.

Speaking to The Tribune, Naseeb Singh said: “We have urged the khap panchayat to change its stand on the issue and there is very much possibility of settling down the controversy soon as some members of the panchayat were also in favour of ending the row by finding out an amicable solution at the meeting.” He further said another vital meeting for almost final judgment had been convened in Dubaldhan village here tomorrow.

Meanwhile, terming the khap panchayat’s diktat directing their “eviction” from the village as “gross infringement of human rights”, Shilpa, wife of Ravinder, has approached the National Commission for Women (NCW) seeking prompt intervention on the issue to save the family from destruction.

Shilpa along with a delegation of the All-India Democratic Women’s Association led by its national leader Sudha Sunder Raman met Haryana in charge of the NCW Yasmin yesterday and apprised her of the developments in the gotra controversy.

Urging a ban on such self-styled panchayats, Shilpa demanded immediate arrest of all those members of the Kadyan Barah khap and villagers against whom criminal cases were registered by the police on the complaint of the Gehlout family some days ago. She also sought ample security for the entire Gehlout family.

A member of the delegation said the NCW had asked the Haryana government to submit an action-taken report in the matter.

The NCW issued a letter to the government to deal sternly with such khap panchayats, the member claimed.


Shilpa Kadyan of Siwah weds with Ravinder Gahlot of Dharana in the month of march, 2009.....routine work, no problem but social network does not allow both of them to get marry because village Dharana comes under barah kadyan khap area, where KADYAN gotra in majority and KADYAN of village Siwah roots also in Dubaldhan adjoining Dharana.Shilpa is a daughter for KADYAN's can not be be a daughter in law....this point was raised by the Kadyan Khap, nothing wrong.
Kadyan Khap International investigate the whole matter and in the opinion that :
-Jat community people think before marry about
* Self gotra
* Mother and grand mothers gotra.
If the proposal for bride or groom does not match any gotra's as mentioned above then no harm to marry.
Ravinder being an a resident of Kadyan dominated village Dharana can not marry to Kadyan gotra girl as this is the compulsion of the society / social network, as reported he was adopted by his aunt (his father sister married in Sultanpur - Delhi) then no harm, if :
-Shilpa and Ravinder should claim for Sultanpur village - adopted parents dynasty not of Dharana family.
- Ravinder's new mother (Bhua)should get her share in her parental property in Dharana and Ravinder shall not be entitle to claim any legal heirs rights.
Some people in Kadyan Khap asked for divorce but Kadyan Khap International not in the same opinion - views, the intention of the KADYAN KHAP was also not wrong and parents of the couple
are responsible for any misunderstanding / controversy in the area, they be asked for clarification, responsible or misrepresenting the facts before society.
Criminal proceeding against all 20 representative of the Kadyan Khap be dropped.
